SECTION 1. GENERAL PROVISIONS
1.1 This User Agreement (hereinafter referred to as the «Agreement») governs the use of the Saidova.store website and services available at:
1.2. The owner and administrator of the Website is an individual entrepreneur, Alina Gershivna Eksman, location: 58029, Ukraine, Chernivtsi region, Chernivtsi, 11 Pylypa Orlyka str: 3531004483 (hereinafter referred to as the «Administration»).
1.3. By using the Website, the User confirms familiarization and full agreement with the terms of this Agreement.
1.4. If the User does not agree to the terms of this Agreement, he/she must stop using the Website.
1.5. The Administration shall have the right to amend or supplement this Agreement at any time without separate notice to the Users.
The current version of the Agreement is always available on the Website.
1.6. Continued use of the Website after amendments to the Agreement means that the User agrees to such changes.
SECTION 2. TERMS AND DEFINITIONS
2.1. Website means the Saidova.store website located on the Internet at the following address:
2.2. Service - the functionality of the Site that allows you to view products, place orders,
receive information and use other features of the Website.
2.3. User - any individual, individual entrepreneur or legal entity using the Website.
2.4. Goods - products presented for sale on the Website.
2.5. Intellectual property means all copyrighted works, trademarks, logos, photographs, texts, design elements and other materials posted on the Website.
SECTION 3. REGISTRATION AND ORDERING
3.1. To place an order, the User shall provide relevant and accurate information, in particular:
first and last name;
phone number;
email address;
delivery address;
other data required to fulfill the order.
3.2. The User is responsible for the accuracy of the information provided.
3.3 The Administration is not responsible for the impossibility of fulfilling the order if the User provides incorrect or incomplete data.
3.4 Placing an order on the Website means:
the User's consent to the terms of this Agreement;
consent to the processing of personal data in accordance with the Privacy Policy;
confirmation of the intention to purchase the relevant Product.
SECTION 4. PAYMENT AND DELIVERY
4.1 Payment for the Goods shall be made by the methods available on the Website at the time of placing the order.
4.2. Delivery is carried out by the delivery services indicated on the Website.
4.3. Delivery times may depend on the work of carriers, delivery region, holidays and other circumstances beyond the control of the Administration.
4.4. The risk of accidental damage or loss of the Goods passes to the User from the moment of receipt of the order.
SECTION 5. RETURN AND EXCHANGE OF GOODS
5.1. Return and exchange of the Goods are carried out in accordance with the requirements of the legislation of Ukraine.
5.2. The User has the right to return or exchange the Goods of good quality within the period established by the legislation of Ukraine, provided that the presentation, packaging, labels and no traces of use are preserved.
5.3. The Administration has the right to refuse to return the Goods in cases provided for by the legislation of Ukraine.
SECTION 6. INTELLECTUAL PROPERTY
6.1. All materials posted on the Site are subject to intellectual property rights and are protected by the laws of Ukraine.
6.2. It is prohibited to copy, distribute, use photos, texts, design, logos or other materials of the Website without the prior written consent of the Administration.
6.3. The User shall not use the materials of the Website for commercial purposes without the permission of the Administration.
SECTION 7. PERSONAL DATA
7.1. The processing of personal data is carried out in accordance with the Privacy Policy and the Law of Ukraine «On Personal Data Protection».
7.2. By using the Website, the User agrees to the processing of personal data within the limits and for the purposes specified in the Privacy Policy.
SECTION 8. RESTRICTIONS ON THE USE OF THE SITE
8.1. The User is prohibited from:
use the Website in a manner that violates the laws of Ukraine;
post false, offensive or illegal information;
interfere with the operation of the Site;
take actions that may lead to disruption of the Website;
use the materials of the Site without the permission of the Administration.
8.2. The Administration has the right to restrict the User's access to the Website in case of violation of the terms of this Agreement.
SECTION 9. LIMITATION OF LIABILITY
9.1. The Administration is not responsible for:
temporary interruptions in the operation of the Website;
delivery delays caused by carriers;
technical failures that occurred through no fault of the Administration;
there may be differences in the color or shade of the Goods in the photos depending on the User's screen settings.
9.2. The Website and its functionality are provided on an «as is» basis.
9.3. The Administration makes every effort to ensure the relevance and accuracy of the information on the Website, but does not guarantee the absolute absence of technical errors or inaccuracies.
SECTION 10. FINAL PROVISIONS
10.1. All disputes arising between the User and the Administration shall be resolved through negotiations.
10.2. In case of impossibility to settle the dispute through negotiations, the dispute shall be considered in accordance with the legislation of Ukraine.
10.3. If any provision of this Agreement is found to be invalid, this shall not affect the validity of the remaining provisions of the Agreement.
10.4. The legislation of Ukraine shall apply to the relations between the User and the Administration.
